Two entities in the wireless industry have submitted a petition to the Federal Communications Commission (FCC) to amend federal regulations in regard to small wireless infrastructure; the proposed changes would further erode local authority over the siting of small cells. Some of the more egregious requests include:
- Despite any size restrictions, structures on poles could be expanded horizontally and vertically to the specification the provider seeks.
- Authorization to place a wireless facility on a portion of a building means automatic approval for placement of more facilities on other portions of the same building.
- Limits local authority to regulate wireless facility aesthetics located poles owned by utilities in public rights-of-way.
A public notice has been issued with links to the petition and details on how to file comments in opposition to these proposed changes; comments are due by October 15.
